The Service Provider shall use its best endeavours to ensure that the Consultant(s) shall carry out the Consultant Services in accordance with the information, instruction and requirements of the Client as stated by the Client from time to time.
3.1.2 (…)
The Service Provider hereby warrants that the Consultant(s) have the skill and competence to meet those requirements, that it will perform the Consultant Services with skill, integrity and competence using its own equipment as appropriate, that the Consultant(s) will perform all duties they are engaged to perform and that the Client expects them to perform and that the work performed pursuant to the Particular Agreement will be of a quality satisfactory to the Client. In de door Percival gebruikte standaard arbeidsovereenkomsten, waarin Percival staat vermeld als “The Employer”, de consultant als “The Employee” en de SThree Company als “Agency” staat onder meer:
“Whereas:
a) The Parties wish to enter into a contract of employment with each other, whereby the Employee undertakes to perform work at an (End) Client for the Employer in return for pay for a fixed term, namely for the duration of the project referred to below.
b) On the basis of this contract of employment the Employer will outsource the Employee to an (end)Client
c) The Employee will perform work under supervision and management of an (End) Client in accordance with instructions issued to the Employer.
d) The Parties hereby wish to record this contract of employment and the accompanying terms and conditions in writing.

Article 4. Term of contract of employment
Project: agreement between an Agency and/or Preferred Supplier/Client with respect to the work that needs to be carried out with due regard for the capacities of the Employee at the (End) Client’s premises.
Agency: intermediary with whom the Employer has entered into a master agreement and/or sub-agreement for the benefit of outsourcing the Employee to an (End) Client.
Client: company for whom the Employee performs work.
Preferred Supplier: intermediary who enters into an agreement with the Agency and places the Employee with an (End)Client.
(End)Client: company at which the Employee actually performs work.

Article 5. End of contract of employment and premature termination
The contract of employment is entered into for the duration of the Project and terminates by operation of law upon completion of the Project, without prior notice to this effect being required. The Project will terminate - with due regard the notice period conform the Collective Labour Agreement (CAO voor Uitzendkrachten(ABU)) -, as soon as:
- the Client/Preferred Supplier or the Agency states that the assignment has come to an end;
- the Client/Preferred Supplier or the Agency states that the work has come to an end;
- the Client/Preferred Supplier or the Agency states that the Employee will no longer be allowed to perform the agreed work.
